These Terms of Service (these "Terms") constitute a binding agreement between you and Connect Technologies LLC, a New York limited liability company doing business as Campus Connect ("Campus Connect," "we," "us," or "our"), and govern your access to and use of the Service. These Terms apply to Students. Couriers are governed by the Courier Agreement and the Courier Rules, and not by these Terms.

PLEASE READ THESE TERMS CAREFULLY. SECTION 9 AND THE REFUND POLICY PROVIDE THAT WE DO NOT REFUND THE PRICE OF FOOD, AND SECTION 15 LIMITS OUR LIABILITY FOR CERTAIN LOSSES.

1. Definitions

The following terms have the meanings set out below wherever they appear in these Terms and in the Refund Policy:

2. Acceptance of These Terms

2.1 You accept these Terms each time you pay for a Delivery. At checkout, the statement immediately above the payment button provides that, by paying, you confirm that you are at least eighteen (18) years of age, that you placed the Order or are authorized to collect it, and that you accept these Terms, the Privacy Notice, and the Refund Policy, each of which is linked and available for review before you proceed. Selecting the payment button, whether it reads "Accept and pay" or "Pay with card" or is the Apple Pay or Google Pay button, constitutes your acceptance. If you do not agree, you must not select it.

2.2 We maintain a record of each acceptance, including the versions of these Terms, the Privacy Notice, the Refund Policy, and the checkout statement you accepted; the date and time; the Delivery; your Account, if you were signed in; and the application and application version used. We retain that record after the Delivery is completed and after any deletion of your Account.

2.3 The Refund Policy is incorporated into and forms part of these Terms. The Privacy Notice describes the personal information we collect, the purposes for which we use it, the recipients to whom we disclose it, and how long we retain it.

2.4 Certain features of the Service, such as creating an Account or uploading a screenshot, may be used before payment. By using those features, you agree to comply with Sections 5 and 12.

3. Eligibility

3.1 Age. You must be at least eighteen (18) years of age to use the Service. You confirm your age at each checkout. A parent or guardian may not accept these Terms on behalf of a person under eighteen (18). If we learn that you are under eighteen (18), we may close your Account and decline your Deliveries.

3.2 Authority over the Order. You must be the person who placed and paid for the Order, or be authorized by that person to collect it.

3.3 Service area. The Service is available only at the campuses, Venues, and Handoff Spots displayed in the app. Couriers collect Orders from the campus pickup location and deliver only to Handoff Spots on the same campus. The Service does not deliver off campus.

3.4 Accounts. An Account requires an email address issued by a school we serve, such as an address ending in @albany.edu. You may also pay for a Delivery as a guest without an Account, as provided in Section 5.

4. Nature of the Service

4.1 Campus Connect provides a pickup-and-delivery service that is separate from the purchase of food. You purchase food from the Venue by whatever means the Venue offers and then engage Campus Connect to collect the completed Order and carry it to your Handoff Spot. Our charges are limited to the Delivery Fee and any Tip.

4.2 Campus Connect does not prepare, sell, price, or modify food. We do not display menus or food prices, and we do not accept orders or payments for food. Campus Connect is not affiliated with, endorsed by, or acting on behalf of any Venue, ordering application, university, or campus dining program, except as stated in a separate writing signed by us.

4.3 We do not guarantee:

4.4 We will not collect or carry alcohol, tobacco or nicotine products (including vaping products), cannabis, controlled substances, any other age-restricted goods, or any unlawful item. A Courier presented with any such item will decline to carry it.

5. Accounts, Guest Orders, and Friends

5.1 Your Account. You sign in with your school email address and either a password or a one-time code sent to that email address. You are responsible for maintaining the security of your password and devices and for keeping your name, mobile number, and residence information accurate. You may not create an Account for another person or permit any other person to use your Account.

5.2 Delivery links. Each Delivery has its own private means of access in the app. Any person holding that access may follow your Courier and view your Handoff Spot, and you should not share it with anyone who should not see that information. Access expires fourteen (14) days after the Delivery is delivered or cancelled. We may disable it sooner if it has been shared inappropriately, in which case you may contact us to cancel the Delivery.

5.3 Guest Orders. You may pay for a Delivery without an Account by providing your name, mobile number, and email address on the payment form. If you later sign in to an Account using the same email address, your Guest Orders will be associated with that Account.

5.4 Friends. This optional feature requires an Account. Two Students whose Deliveries were linked by an invite code may add each other as friends. A friend can see your first name and any group you share that was made in an earlier version of the app. Being friends never shows a friend when you are ordering. Campus Connect does not send notifications about friends or groups. You may remove a friend, and leave any group made in an earlier version of the app, at any time.

5.5 Account deletion. You may delete your Account in the app under Account. Deletion is not available while a Delivery of yours is in progress, for one (1) day after you begin a checkout that you do not complete, or while you are carrying a Route as a Courier. Deletion is permanent. The Privacy Notice describes the records we retain after deletion and the reasons for retaining them.

5.6 Termination of access. We may terminate your access to the Service, close your Account, disable a delivery link, or decline Deliveries if you breach Section 12, if we reasonably believe that a Delivery is unsafe or unlawful, or if required by law.

6. Requesting a Delivery

6.1 Order details. You provide the details of your Order by uploading a screenshot of the Venue's order confirmation or by entering them manually. We extract the Venue, order number, and pickup ready time from that information. You are responsible for the accuracy of those details and for ensuring that the Order is yours to collect.

6.2 Handoff Spot. You select a Handoff Spot from those offered in the app and may place a Delivery Pin, add a building or room detail, request napkins and utensils, and leave a note for your Courier. The Handoff Spot cannot be changed after payment. To change it before Pickup, you must cancel and submit a new request.

6.3 Authorization to collect. By paying, you authorize Campus Connect and the Courier assigned to your Delivery to identify your Order using the details you provided; to show Venue staff your order number, your name, and your screenshot; to collect the Order on your behalf; and to carry it to your Handoff Spot.

6.4 Early readiness. If your food is ready earlier than the app indicates, you may so indicate on the delivery screen, and we will begin seeking a Courier earlier.

6.5 Scheduling failure. If we are unable to determine when your Order will be ready, no Courier will be dispatched and the delivery screen will so indicate. You may request assistance or cancel without charge.

6.6 Refusal by the Venue. If Venue staff decline to release your Order to the Courier before Pickup, the Courier will cancel the Delivery, the app will notify you, and you will not be charged. Your food order with the Venue is unaffected, and any matter concerning it is between you and the Venue.

7. The Handoff

7.1 Meeting your Courier. Couriers will come to your Handoff Spot and will enter a building only lawfully; they will not follow another person through a secured entrance, use another person's card or code, or call another unit. At a residence hall or campus apartment building, your Courier may bring your Order to the door of the room you specified when selecting your Handoff Spot, but only if the building's visitor rules permit it and the Courier can enter lawfully, meaning that the building is open to the public at that hour, you admit the Courier (by opening the entrance in person or by releasing it from your own unit's call box), or the Courier resides there and uses their own access. If the Courier cannot enter, the Courier will hand over the Order at the building entrance and message you to come down. Couriers will not enter your room, any other private residence, any classroom, or any office. You must select a Handoff Spot that is lawful, safe, and reasonably accessible, and follow your Courier's reasonable safety directions.

7.2 Handoff Code. You provide your Handoff Code to your Courier, who enters it to complete the Delivery. We never include the Handoff Code in a notification. After repeated incorrect entries, the Handoff Code is disabled for that Delivery and the Courier completes the Delivery with a photograph instead.

7.3 Leave at my door. At a residence hall or campus apartment building, you may request that your Order be left outside the door of the room you specified instead of meeting your Courier. This election must be made before payment and cannot be changed afterward, and no Handoff Code is required. If your Courier can enter as described in Section 7.1, the Courier will leave your Order outside that door and complete the Delivery with a photograph showing the door and its room number, without waiting for you, and the app will notify you and display the photograph. Once that photograph shows your Order at the door of the room you specified, the Delivery is deemed delivered, and we will not refund the Delivery Fee or Tip if the Order is subsequently lost. This Section 7.3 does not apply if the photograph shows a different door or if your Courier caused the loss; either case is treated as a Courier-caused problem under the Refund Policy. If your Courier cannot enter, the Courier will message you and hand over the Order at the building entrance using your Handoff Code.

7.4 If you cannot be reached. Unless you elected "Leave at my door," Couriers are required to message you and wait at least three (3) minutes before leaving your Order, at the door of the room you specified if they reached it as described in Section 7.1, and otherwise at your Handoff Spot. If you are not present and do not respond, the Courier may then leave your Order at that location, photograph it, and complete the Delivery. A photograph taken at a room door shows the door and its room number. The app will notify you when this occurs, and you may view the photograph on your delivery screen. We retain the photograph with the Delivery record for thirty (30) days after the Delivery, as described in Section 6 of the Privacy Notice, and if you report that the Order did not reach you, a member of Campus Connect's staff will retrieve the photograph and review it against your report. A Delivery completed in this manner is deemed delivered. If the Courier left the Order somewhere other than the door of the room you specified or your Handoff Spot, or did not message you and wait, you should notify us, and the matter will be treated as a Courier-caused problem under the Refund Policy.

7.5 Courier identity. While a Courier is carrying your Order, you will see the Courier's first name and photograph. The Privacy Notice describes what else is displayed and for how long. If the person who arrives is not the person shown in the photograph, you are not required to provide your Handoff Code or accept the Order, and you may report the matter from the delivery screen.

7.6 Messages. Once a Courier has been assigned, you may message the Courier in the app regarding the handoff of that Delivery. The conversation closes when the Delivery ends, and we may limit the number of messages sent. Messaging is not a means of contacting Campus Connect; please use Help for that purpose.

7.7 Ratings. After a Delivery is completed, you may rate it once, from one (1) to five (5) stars, with an optional comment. Admin reviews comments without your name attached, and a Courier whose ratings fall below our standard is reviewed. Once a Courier has received enough ratings, Students whose Orders the Courier carries can see the Courier's average rating and number of ratings. A rating is not the appropriate means of reporting a serious matter; please use Help.

8. Fees, Tips, and Payment

8.1 Charges. For each Delivery, you agree to pay the Delivery Fee and any Tip. No other charge, including any service fee, surge price, or small-order fee, will be added. The Delivery Fee is determined by the campus and the Handoff Spot you select and currently ranges from $2.99 to $3.99, before any promotion (Section 8.8). The app displays the Delivery Fee, the Tip, and the total before you pay. The Delivery Fee does not vary based on your identity.

8.2 Tips. Tips are optional. Checkout proposes a Tip, which you may change to no tip or to any amount up to $10.00. Your Courier receives the entire Tip. Tips are paid in addition to, and never count toward, the Courier's pay for the Route.

8.3 The Hold. When you pay, we place a Hold on your card for the total amount. You are not charged at that time, although your bank may show the amount as pending. Your card is charged at Pickup. If a promotion lowers what you pay, we charge only the lower amount and release the rest of the Hold, and if nothing is left to charge, no charge is made. If the Delivery ends before Pickup, whether because you cancelled or because the Venue declined to release the Order, we release the Hold and no charge is made. The time a released Hold takes to disappear from your statement is determined by your bank. A Hold remains valid for approximately seven (7) days. If a Hold lapses or is cancelled before your card is charged, a member of our staff may contact you regarding payment of what you owe, which is never more than the amount you agreed to at checkout.

8.4 Declined cards. If your card is declined, no charge is made and your Delivery does not begin. You may use a different card.

8.5 Payment processing. Payments are processed by Stripe, Inc. We do not receive or store your full card number.

8.6 Receipts. After the handoff, we email a receipt to the email address associated with the Delivery or, if none, to your Account's email address. If neither exists, no receipt is sent. Students who are signed in may also view receipts under Orders.

8.7 Invite codes. After you pay, your Delivery receives an invite code, which the app places in the links you share. Another Student who places a Delivery with your code, to a Handoff Spot in the same area of campus and before your food is ready (or, if your Delivery has no ready time, within fifteen (15) minutes of your payment), has their Delivery linked to yours, and the two of you may then add each other as friends (Section 5.4). An invite code does not change any Delivery Fee, and each Student pays their own Delivery Fee.

8.8 Promotions. We may from time to time offer promotions, such as a promo code or a lower Delivery Fee at certain times. A promotion's details are shown in the app or in the message that offers it, and we may change or end a promotion at any time; a change never affects a Delivery already paid for. A promotion only ever lowers what you pay.

8.9 Added Tips. For twenty-four (24) hours after the handoff, you may add to your Courier's Tip from the delivered screen or, if you are signed in, from that Delivery's receipt under Orders. Each Added Tip must be at least $1.00 and is charged to your card immediately as a separate payment. The Tip and all Added Tips for a Delivery may not exceed $10.00 in total. A Tip may be increased but never reduced. All Tips and Added Tips are paid to the Courier who handed over your Order.

8.10 No direct payments to Couriers. All payments are made to Campus Connect through the app. If a Courier requests payment by any other means, do not send it, and notify us.

8.11 Deliveries with nothing to charge. If a promotion leaves no Delivery Fee to pay and you add no Tip, or a Tip of less than $0.50, no card is needed, but you must be signed in to an Account with a verified school email address at the school the Delivery is at to place the Delivery, and only one such Delivery may be under way on an Account at a time: to place another before the first is delivered or cancelled, add a Tip of $0.50 or more. A Tip of less than $0.50 is still paid to your Courier. If a promo code is applied to a Delivery that another promotion has already made free, the promo code is not consumed.

9. Cancellations and Refunds

9.1 The Refund Policy sets out, stage by stage, which Deliveries may be cancelled and what amounts are refunded. In summary:

9.2 Cancelling a Delivery does not cancel your food order with the Venue.

10. Food and the Venue

10.1 The Venue, and not Campus Connect, is responsible for your food, including its preparation, ingredients, allergens, dietary suitability, packaging, accuracy, and completeness. You should review the Venue's allergen and ingredient information before ordering. If you have a severe allergy or a food-safety concern, you must not rely on Campus Connect or your Courier to inspect, verify, or alter your Order.

10.2 Couriers carry only food and beverages that the Venue has placed in closed carryout packaging, whether handed over by staff or left in the pickup area. Such packaging may not be tamper-evident, and a lidded beverage may have a sipping opening. At Pickup, Couriers verify the order reference, the exterior of the packaging, and the Venue's receipt against the bags and beverages handed over, beverages included. Couriers do not open packaging, touch food or beverage openings, or make any statement regarding food quality. Because the Order remains closed, we cannot confirm its contents. If a bag or beverage listed on the receipt was not handed over and the Courier nonetheless marked your Order collected, that is a Courier-caused problem under the Refund Policy. An error inside sealed packaging is the responsibility of the Venue.

10.3 Any claim concerning the food itself must be directed to the Venue. On request, we will provide the Delivery record, including the order reference and the pickup and handoff times, in support of your claim.

11. Couriers

11.1 A Courier collects and carries your Order at your request. A Courier is not an agent or employee of the Venue and has no authority to buy, sell, price, modify, accept returns of, or make representations about food on behalf of any person.

11.2 A Courier has no authority to promise you any refund, credit, or other payment on our behalf. Only Admin may make such decisions.

11.3 Until your Order is handed over or the Delivery is cancelled, the Courier assigned to your Delivery can see the information needed to collect your Order and locate you: the Venue; the order reference and items; your screenshot; your first name and last initial; your Handoff Spot and any Delivery Pin; any building or room detail and note you provided; and whether you requested napkins and utensils. Couriers not assigned to your Delivery cannot see any of this information.

11.4 Campus Connect is responsible to you for the Delivery as described in these Terms and the Refund Policy, including for your Order while it is in a Courier's possession.

12. Prohibited Conduct

You agree that you will not:

  1. provide a false order reference, or request a Delivery for an Order that you are not entitled to collect;
  2. impersonate any other Student, any Courier, or any other person;
  3. attempt to obtain another person's Order;
  4. use the Service for any item described in Section 4.4;
  5. harass, threaten, discriminate against, or endanger any Courier, Venue staff member, or other person, or bring a weapon to a handoff;
  6. ask a Courier to violate our rules, to enter a building other than as permitted by Section 7.1, to enter your room, or to accept payment outside the app;
  7. misuse invite codes, promotions, ratings, messages, or Help, including by placing Deliveries solely to obtain a free Delivery and then cancelling them;
  8. copy, scrape, overload, probe, or attack the Service, or circumvent any limit it imposes; or
  9. violate any law or the rights of any person.

13. Help and Automated Responses

Help is available in the app. Responses in Help are generated automatically by an artificial-intelligence assistant that relies on our help articles and may be inaccurate, and the Help screen so states. You may request a human representative at any time. Any matter concerning safety, a charge, a refund, or a report about another person is referred to a member of our staff, and only a member of our staff may approve a refund or credit.

14. Disclaimer

The Service is provided as described in these Terms. Campus Connect does not warrant that the Service will be available at all times, free of errors, or able to accept every Delivery. To the extent permitted by applicable law, Campus Connect makes no representation or warranty regarding the Service other than those set out in these Terms and the Refund Policy, and makes no representation or warranty of any kind regarding food, which is sold to you by the Venue.

15. Limitation of Liability

15.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAMPUS CONNECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM A LATE OR FAILED DELIVERY, INCLUDING, WITHOUT LIMITATION, A MISSED MEAL, A MISSED CLASS, OR THE COST OF OBTAINING FOOD ELSEWHERE.

15.2 Section 15.1, and the provision that we do not refund the price of food, do not apply to personal injury, to harm caused intentionally or through gross negligence, or to any other liability that cannot be limited under applicable law. Nothing in these Terms limits any right you have as a consumer under New York law.

16. Disputes and Governing Law

16.1 If a dispute arises, you agree to first contact us at info@campusdelivery.app, providing the Delivery ID and a description of the matter, and we will attempt in good faith to resolve it.

16.2 These Terms are governed by the laws of the State of New York, except where the law of another jurisdiction must apply. To the extent jurisdiction may lawfully be chosen, the courts located in Albany County, New York shall have jurisdiction over any dispute between you and Campus Connect. You may also bring a claim in any small claims court having jurisdiction over it. Nothing in this Section waives any right that cannot lawfully be waived.

17. Amendments

We may amend these Terms with respect to future Deliveries. Each amendment will be published with a new version date, and the app will require you to accept the amended version before your next checkout; payment will not be accepted under a superseded version. The version of these Terms you accepted for a Delivery governs that Delivery, and no amendment applies to a Delivery you have already paid for.

18. Termination

You may stop using the Service at any time and may delete your Account as provided in Section 5.5. We may terminate your use of the Service as provided in Section 5.6. Sections 9, 10, 14, 15, 16, and 19 survive with respect to Deliveries already made.

19. General Provisions

19.1 Intellectual property. Campus Connect owns the Service, including its applications, website, software, and design. Your use of the Service does not grant you any ownership interest in it. You may not copy, resell, or reuse any part of the Service, or our name or logo, without our prior written consent.

19.2 Your content. Screenshots, notes, messages, ratings, comments, and photographs that you submit remain yours. You grant Campus Connect a limited license to use them solely to operate the Service as described in these Terms and the Privacy Notice, and for no other purpose.

19.3 No waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it later.

19.4 Assignment. You may not assign or transfer your Account or your rights under these Terms. We may assign these Terms to a successor to the Service, which shall be bound by them with respect to all Deliveries already made.

19.5 Entire agreement; severability. These Terms, including the Refund Policy, constitute the entire agreement between you and Campus Connect regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

19.6 Electronic records and notices. You agree that we may provide receipts, notices, records of your acceptance of these Terms, and any other communication concerning the Service electronically, by displaying it in the app or by sending it to the email address associated with your Account or your Delivery, and that an acceptance you give by selecting a button in the app has the same effect as a signature. You may obtain a paper copy of these Terms, the Privacy Notice, or the Refund Policy by writing to the address in Section 20. To receive electronic communications you need a device and an internet connection able to run the app or a current web browser, and an email address at which you can receive messages.

19.7 The app stores. If you obtained the app from the Apple App Store or Google Play, the following also apply. These Terms are concluded between you and Campus Connect only, and not with Apple Inc. ("Apple") or Google LLC ("Google"), and Campus Connect, not Apple or Google, is solely responsible for the app and its content. Your license to use the app is non-transferable and limited to devices that you own or control, and, for the Apple App Store, to Apple-branded devices, as permitted by the store's usage rules, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing where the store allows it. Campus Connect, not Apple or Google, is solely responsible for providing any maintenance and support for the app; for addressing any claim by you or any third party relating to the app or your use of it, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar laws; and for the investigation, defense, settlement, and discharge of any claim that the app infringes a third party's intellectual property rights. Apple and Google have no obligation to furnish any maintenance or support for the app or to honor any warranty relating to it. Where a warranty of the app cannot be excluded, and the app fails to conform to it, you may notify Apple and Apple will refund the purchase price, if any, of the app to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app. You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with any applicable third-party terms, such as your wireless carrier's terms, when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the app, and upon your acceptance of these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
